“Sky-high” money at 35: why the Verkhovna Rada has not canceled prosecutors’ golden pensions again

On March 26, MPs sent back for a second first reading draft law No. 12278, which deals with pensions for prosecutors. This was reported by "Komersant Ukrainian" with reference to the Telegram channel of MP Yaroslav Zheleznyak.

The document provides for the abolition of special pensions for prosecutors. According to Danylo Hetmantsev, chairman of the Verkhovna Rada Committee on Finance, Taxation, and Customs Policy, the draft law was intended to abolish the rules that allow prosecutors to receive special pensions worth hundreds of thousands of hryvnias as early as 35 years old.

As MP Iryna Gerashchenko explains, prosecutors can now receive “sky-high” salaries and pensions at the same time. There are “pensioners” in the prosecutor’s office in their 40s and 50s who have received payments for long service and special working conditions.

“This is extremely unfair, especially in the context of war. But! Only 223 MPs supported the important bill, 3 votes short. Well, prosecutors have a strong lobby in the Verkhovna Rada in different factions… And they will continue to receive exorbitant salaries and pensions,” Gerashchenko wrote on her Telegram channel.

What the draft law No. 12278 says

Thedraft law defines the peculiarities of pensions for prosecutors for long service, disability, and survivors’ benefits.

The document proposes to change the procedure for payment of long-service pensions, providing for their payment only after a person leaves the prosecution service.

In addition, the draft law provides for granting the Pension Fund of Ukraine the status of a central executive body with a special status.

The initiators of the draft law, which was registered in the Verkhovna Rada on February 12, 2024, were MP Halyna Tretyakova and a group of her colleagues. The authors of the document say that they aimed to establish uniform conditions for recalculating pensions, regardless of the law under which prosecutors’ pensions are calculated.

In an explanatory note to the draft law, they state that social protection policy should meet the goals and priorities set out in program and forecast documents for economic and social development, as well as take into account other strategic decisions made in wartime.

“Despite the war, Ukraine has faced a situation in which, due to the different application of pension legislation, the number of lawsuits filed by prosecutors over the past 10 years regarding the appointment and establishment of pensions by court decision has increased,” the explanatory note says.

In addition, along with privileged conditions for calculating pensions, prosecutors have the exclusive/unique right to grant long service pensions without leaving their jobs and receive double the prosecutor’s salary.

The MP group that initiated the draft law noted that the adoption of the document will have positive social and economic consequences, promote efficient use of budgetary resources, and increase trust in state institutions in Ukraine.
