The AMCU fines three water producers: what is wrong with Aqua baby, Aqua Karpaty and Shayanska Silicon

The Antimonopoly Committee of Ukraine (AMCU) has fined three companies that disseminated false information about their bottled water brands. These are Lirans LLC, Trading House Morshynski Dzherela LLC, and Shayanski Dzherela LLC. This was reported by the press service of the AMCU, "Komersant Ukrainian" reports
According to the press service of the committee, the producers resorted to unfair competition by placing information on labels, websites and marketplaces that was not true.
What exactly was untrue
The following trademarks were inspected:
- “Aqua baby”
- “Aqua Karpaty
- “Shayanskaya Silicon.
The Committee initiated proceedings based on the applications of OSCAR, which complained about the actions of its competitors, Lirans LLC and Morshynski Dzherela Trading House LLC. According to the applicant, the companies disseminated false information on product labels, websites and/or online marketplaces, in particular, about the origin of such waters from the Carpathians and/or Morshynske deposit, about the products belonging to mineral waters and/or waters intended for baby food, the method of production, consumer properties and certain characteristics of Aqua baby and Aqua Karpaty water.
During the proceedings, Lirans LLC and Trading House Morshynski Dzherela LLC did not provide evidence to support the information on these waters placed in the respective places of distribution. At the same time, the Committee used the information provided by the Western Scientific Center of the National Academy of Sciences of Ukraine and the Ministry of Education and Science of Ukraine during the consideration of the cases.
Expert conclusions
The experts of the Ukrainian Research Institute of Rehabilitation and Balneology found that Shayanskaya Silicon Water does not belong to natural mineral canteens, and the properties declared by the manufacturer are not true.
The AMCU’s decision
The Antimonopoly Committee recognized the actions of all three companies as a violation of the legislation on protection against unfair competition.
The manufacturers were fined, the amount of which was not disclosed.
