The AMCU decides the fate of Kolomoisky’s 245 gas stations: who will get the gas stations

The Antimonopoly Committee is studying the agreement on the transfer of 245 gas stations to Max Energy Resources and MGK Rail. This was reported by the press service of the AMCU, "Komersant Ukrainian" reports
It is noted that the AMCU considered the applications:
- on granting permits to Max Energo Resource LLC for the direct acquisition of assets in the form of 245 single property complexes – gas stations from PrivatBank JSC;
- on granting permits to MGK Rail LLC to acquire joint control over assets in the form of 245 single property complexes – gas stations together with Max Energy Resources LLC.
In the course of reviewing the relevant applications, the Committee identified the grounds for prohibiting the said concentrations.
Taking into account the above, on February 13, 2025, the Committee started consideration of the concentration cases:
- In the form of direct acquisition of assets in the form of 245 single property complexes – gas stations – by Max Energo Resurs Limited Liability Company from PrivatBank Commercial Bank Joint Stock Company.
- In the form of acquisition by MGK Rail and Max Energo Resource Limited Liability Companies of joint control over assets in the form of 245 single property complexes – gas stations.
As a reminder, Max Energy Resources won the auction for the acquisition of 245 gas stations of Privat Group (ANP and Avias chains) and 33 land plots pledged by PrivatBank, offering the highest price of UAH 695.9 million at the auction.
It was noted that PrivatBank and Setam did not confirm the winner. PrivatBank noted that before signing the contract, it would check its ties with the Privat group.
