Anti-corruption audit of OHMATDYT tenders: why the case was not prosecuted

The National Anti-Corruption Bureau of Ukraine (NABU) did not find any violations punishable by the Criminal Code of Ukraine during the inspection of tenders for the reconstruction of the National Children’s Specialized Hospital of the Ministry of Health of Ukraine OKHMATDYT. This was exclusively reported by Anton Tatarnikov, Deputy Head of the Media Relations Department, Head of the Press Service Sector, in a response to "Komersant Ukrainian".
on May 5, 2025, the editorial board of sent a request to the NABU. It stated the following:
“In August 2024, during a briefing, NABU Director Semen Kryvonos said that the Bureau was conducting information and analytical work on the scandalous tenders for the reconstruction of OKHMATDYT. Please inform us about the results of these inspections.
In response, the media received a document from the agency stating that “based on the results of the information and analytical work, there was no sufficient data to indicate the presence of signs of criminal offenses during the reconstruction of the National Children’s Specialized Hospital of the Ministry of Health of Ukraine “Ohmatdyt”, which are under the jurisdiction of the National Bureau in accordance with Part 5 of Article 216 of the CPC of Ukraine”.

It should be noted that part 5 of Article 216 of the CPC of Ukraine Jurisdiction states that in criminal proceedings concerning crimes under Articles
- 209 – Legalization (laundering) of the proceeds of crime
- 384 – Misleading a court or other authorized body
- 385 – Refusal of a witness to testify or refusal of an expert, specialist or interpreter to perform their duties
- 386 – Obstructing the appearance of a witness, victim, expert, specialist, forcing them to refuse to testify or give an opinion
- 387 – Disclosure of data of operational and investigative activities, pre-trial investigation
- 388 – Unlawful actions with respect to seized property, pledged property or property described or subject to confiscation
- 396 – Concealment of a crime
…of the Criminal Code of Ukraine, the pre-trial investigation is carried out by the investigator of the body under whose jurisdiction the crime in connection with which the pre-trial investigation was initiated is subject to.
Scandalous tenders for the reconstruction of OKHMATDYT: what you need to know about them
on July 22, 2024, a tender was announced for engineering and consulting services for construction work for the Okhmatdyt Children’s Hospital, which was destroyed after shelling. Vassenov Engineering LLC was announced the winner. This company was the only participant in the auction, and the contract with it has not yet been made public. The company submitted a bid for UAH 9 million 350 thousand and, accordingly, this was the amount eventually agreed upon by the parties.
For this money, the winner had to carry out preparatory work for the current repair of the building by the end of this year: draw up schedules for the execution of work, supply of materials, recruit appropriate personnel, manage and lead the project, etc.
Another tender was also held on Prozorro, but this time for services for technical supervision of construction work at Okhmatdyt. It was won by another company, IK-PROEKT LLC, which offered a price of UAH 5 million 215 thousand for its services.
At the same time, it became known that the non-governmental organization Okhmatdyt – Healthy Childhood Charitable Foundation, which operates with donors’ money, is also holding a tender for the repair of Okhmatdyt. It was attended by 14 companies. Given that the tender was conducted by a non-governmental organization, there was no expected cost, and the winner was determined not by the bid price, but by the sum of points for various evaluation criteria.
The winner was Bud-Technology LLC, despite the fact that this proposal was one of the most expensive among all the other bidders. The cost of the works from this contractor amounted to UAH 307 million excluding VAT, while other participants offered to perform repairs much cheaper – from UAH 42 to UAH 286 million. At the same time, the Foundation did not provide any explanation for ignoring the cheaper bids, even though at least seven of them contained fully completed commercial proposals with a detailed description of the work and prices.
Instead, the Okhmatdyt Charitable Foundation posted a statement on Facebook denying all allegations of non-transparency and dishonesty in the use of funds raised to rebuild the damaged hospital building.
“The tender procedure was open, meaning that any company could participate. We are currently preparing a detailed report on the competitive selection and the companies that participated in the tender on the SmartTender platform,” the foundation said in a post on its social media page.
In August 2024, NABU Director Semen Kryvonos said the following on camera:
“Regarding OKHMATDYT, we are generally investigating the involvement of those entities under NABU’s investigation. But it is too early to say that we will register proceedings on this fact

Russia’s missile attack on OKHMATDYT hospital on July 8
on July 8, 2024, during another massive missile attack during the Russian-Ukrainian war, the hospital suffered significant damage from a Russian X-101 cruise missile strike. The strike damaged the hospital’s buildings, destroyed some of the medical facility’s buildings, smashed windows and glass, and caused casualties.
The Russians destroyed the building of the toxicology department, where seriously ill children were on dialysis, five oncology departments, ten surgical departments, two somatic departments, an intensive care unit, two intensive care units, operating units, radiation and radiotherapy departments, and three other buildings were damaged. Two electrical substations that powered the entire hospital infrastructure were also destroyed.
As of mid-day, two adults (one of them a doctor) and seven children were reported dead and injured. on July 10, a boy died who was in critical condition in the intensive care unit at the time of the July 8 attack on OKHMATDYT.
on July 9, 2024, OKHMATDYT director Volodymyr Zhovnir addressed the UN Security Council. In his speech, he stated that at the time of the strike, about 1200 people were in the hospital and 3 complex operations were underway. The attack killed 2 people and injured about 300, including 8 children. He also noted that the attack damaged 24 departments, which will limit the ability to provide quality medical services to those in need.
Immediately after the attack on the hospital, Ukrainians began raising funds to rebuild OKHMATDYT.
