Businesses are concerned about stalled bookings and offer authorities a temporary solution

The European Business Association (EBA) has expressed deep concern over the sudden suspension of the electronic booking procedure for critical employees of companies through the Diia portal. This is stated in a statement by the EBA, published today, 21 October, according to "Komersant Ukrainian"

According to the association, on 20 October, the Ministry of Economy of Ukraine also suspended the process of issuing booking orders for companies that used the paper procedure.

The business community is extremely concerned not only about the suspension of the booking process, but also about the lack of clear official communication from the government. EBA representatives emphasise that business, which is the main source of funds for the state’s defence, does not understand how the booking procedure will continue and how to plan its operations.

They also note that this situation affects not only the domestic market, but also cooperation with international partners, creating negative signals for investors and customers. Business representatives note that the sudden increase in taxes for white businesses, and now the interruption in employee bookings, undermine foreign partners’ confidence in Ukrainian companies, which can lead to the loss of orders and contracts.

“Questions also arise as to the legitimacy of the suspension of the booking procedure for an audit, as neither the relevant law “On mobilisation training and mobilisation” nor the aforementioned government decision provides for it,”

Over the course of the day, the EBA received dozens of requests from business representatives who are already in the process of rebooking or were planning to submit documents in the near future.

Therefore, the EBA proposes to automatically extend existing bookings for the duration of the audit.

“As a possible temporary solution to this situation, the business proposes to consider the possibility of automatically extending the validity of existing bookings in the Oberig register for 60 calendar days for all critical employees of companies whose bookings expire during the duration of this ‘audit’ – 3 days (since Diia considers applications up to 72 hours), i.e. from 17 October to 18 November,”

– the statement reads.

The European Business Association also hopes to resume a dialogue with the authorities and take into account business feedback when making such important decisions.

As reported , on Sunday, 20 October, it became known that the booking service through the Diia app had been temporarily suspended. When trying to book an employee, the app says that the service is not available until 15 November, as an audit of booked conscripts is being conducted.

Criteria for companies critical to the economy

Cabinet of Ministers Resolution No. 76 sets out the criteria for recognising an enterprise as critical to the functioning of the economy and the livelihoods of the population during a special period:

  1. the total amount of taxes paid exceeds the equivalent of EUR 1.5 million;
  2. the amount of foreign currency revenues exceeds the equivalent of EUR 32 million;
  3. the company is of strategic importance for the economy and security of the state according to the list;
  4. the enterprise is important for a sector of the national economy or for meeting the needs of the territorial community;
  5. no arrears in the payment of a single contribution to the obligatory state social insurance;
  6. the average salary of the insured employees at the enterprise for the last calendar quarter is not less than the average salary in the region for the fourth quarter of 2021;
  7. the company is a resident of Diia City.

An enterprise is recognised as critical if it meets at least two criteria. Such enterprises can book 50% of their employees, or more “in case of a justified need”.
