Kudrytsky’s case: the tape was blown off. What about the procedure?

A few days later, there was an explosion of emotions. Posts, streams, statements: it seems that only the lazy have not expressed their “fuh”. Kudrytsky is a recognizable face of the energy front, so the wave of support is powerful. But let’s be honest: emotion does not equal assessment of the crime.
Here are the arguments that are now being cited in his defense (briefly):
– “Good reputation and trust of partners”.
– “Synchronization with ENTSO-E in 2022”.
– “7 years have passed – too long”.
– “No losses – the advance was returned under the guarantee.”
– “Wrong qualification / wrong body / ‘pechersk justice'”.
These points are important for the context, but none of them answers the main legal question: whether or not the specific actions of a particular person constitute a crime. Reputation, achievements, past merits, even doubts about jurisdiction are not evidence of guilt or innocence.
About “a long time”. Yes, 7 years is a long time, and it is annoying. But time alone does not make the process unfair. That’s why there is a statute of limitations: if it hasn’t expired, “long ago/recently” is an emotion, not an argument. In mature democracies, cases against ex-leaders last for years, and this is normal if the process is clean.
And one more important note. I am not a supporter of the SBI. Moreover, I often believe that the Bureau is detached from reality and does not perform its tasks properly. But there must be a measure. A continuous “everything is bad” without trying to act through the tools is a path to irresponsibility. Criticism should be constructive and procedural: appeals, official appeals, complaints to the HCJ, the work of public control councils, and the requirement for motivational parts of decisions – not verdicts in the tape.
Conclusion.
No to immunity. No to lynching on Facebook. Yes to the procedure.
Do we want justice? Documents and process first, then conclusions. Otherwise, even the most righteous anger turns into another brick in the great wall of mistrust.
