Construction tenders: customers are obliged to publish prices for materials and equipment in Prozorro

The Verkhovna Rada has adopted the law “On Amendments to the Law ‘On Public Procurement’ to Ensure Public Disclosure of Information on Prices for Material Resources by Customers in the Electronic Procurement System for the Procurement of Services for Routine Maintenance and Construction Works (Transparent Construction)”. The corresponding draft law No. 11057 was supported in the second reading by 267 MPs.

The law requires customers to publish information on prices, changes in prices for material resources, as well as transportation costs and procurement and storage costs) in the procurement of services for routine maintenance, construction, expansion, reconstruction, overhaul and restoration of industrial and non-production facilities and structures, services for routine maintenance and construction of facilities with the development of project documentation.

Documents containing information on the prices of material resources must contain the following information: name (with characteristics), unit of measurement, quantity, selling price, as well as transportation and procurement and storage costs.

According to the explanatory note, this is to ensure transparency of information on the use of public funds for the procurement of services for current repairs, overhauls and construction.

In particular, the law stipulates that the procurement agreement and all annexes thereto (including documents containing information on prices for material resources) must be published in a machine-readable format within three business days from the date of its conclusion.

For the period of the legal regime of martial law in Ukraine, if the procuring entity makes a procurement, provided that the procurement value is equal to or exceeds UAH 50 thousand, the procuring entity shall publish in the electronic procurement system a report on the procurement contract concluded without the use of the
electronic procurement system, no later than 10 business days after the date of conclusion of such agreement.

This Law will come into force on the day following the day of its publication and will be enacted one month after its publication.
