Due to an agreement that did not include a lease clause, the budget lost 1.9 million hryvnias

In Kyiv, an indictment has been filed against the head of a municipal cultural institution, who is accused of official negligence. According to the investigation, his actions resulted in the city budget paying nearly 1.9 million hryvnias in rent for land used by a private company.
This was reported by the Kyiv City Prosecutor’s Office, as reported by "Komersant Ukrainian".
The official is accused of official negligence
The defendant is the head of the municipal institution, the Kyiv Municipal Academic Chamber Choir.
According to the investigation:
- the municipal concert institution paid rent for the land for over four years;
- in fact, the plot was used by a private investor company;
- the head of the institution failed to take measures to rectify the terms of the contract.
How the land payment scheme arose
The situation arose due to a supplementary agreement to the investment contract regarding construction on the plot on Laboratorna Street.
Initially, the agreement provided for:
- the construction of an office building with a parking lot;
- payment of land rent by the investor.
However, in a subsequent addendum, the clause regarding the investor’s payment of rent was removed, and the management of the municipal enterprise did not initiate any changes.
As a result, the municipal enterprise paid for land that it did not actually use.
How much money was lost from the budget
According to the prosecutor’s office, over several years:
- the municipal enterprise paid nearly 1.9 million UAH in rent;
- these funds were spent from the capital’s budget.
During the pre-trial investigation, the investor partially reimbursed the expenses.
Specifically:
- UAH 1.71 million was reimbursed.
At the same time, prosecutors filed a civil lawsuit for the amount of damages that remained unpaid.
What punishment does the law provide for
The defendant’s actions are classified as official negligence resulting in serious consequences.
The penalty under this article provides for:
- 2 to 5 years of imprisonment;
- a ban on holding certain positions for up to 3 years;
- a possible fine.
Other cases involving property in the capital
Previously, the Kyiv City Prosecutor’s Office reported on other cases related to property and budget funds in the capital.
Specifically:
- the state reclaimed land plots linked to Viktor Medvedchuk and Oleksandr Klymenko;
- a case regarding an overpayment of 1.8 million hryvnias for electricity for educational institutions was referred to court;
- the prosecutor’s office also investigated the illegal seizure of a building in central Kyiv in the interests of the Russian state corporation Rosatom.
