The Kyiv Regional Prosecutor’s Office will appeal the decision of the Brovary City District Court to reconcile Volodymyr Maibozhenko (former head of the district state administration), who committed an accident in April 2024 and injured four people, with the victims. This was reported by "Komersant Ukrainian", citing information on the website of the regional prosecutor’s office.
The prosecutor has already filed a written objection to the impossibility of concluding a reconciliation agreement in proceedings of this category, the inconsistency of the provisions of the agreement with the interests of society and the requirements of the Criminal Code of Ukraine.
What was the decision of the Brovary City District Court?
Judge Tatyana Vasylenko issued a verdict that ordered Volodymyr Maibozhenko to pay a fine of UAH 31,432. His Volvo car, which was kept at the impound lot, was returned to him.
In addition, the court refused to allow the prosecutor to examine the case file during the trial, which showed that there was no mitigating circumstance in the form of active assistance in solving the criminal offense by the accused.
What is known about the accident involving Maybozhenko
on April 26, 2024, in Brovary, an official driving a Volvo failed to stop at a prohibiting traffic signal at an intersection, drove to the side of the road and hit pedestrians. The victims included three adults and a child.
Later it turned out that Volodymyr Maibozheko was driving drunk.
on April 27, the official was dismissed from his post by order of President of Ukraine Volodymyr Zelenskyy. On the same day, he was notified of suspicion under the article on violation of traffic safety rules by a person driving a vehicle while intoxicated.
On September 4, 2024, the Brovary City District Court released the former head of the Brovary District State Administration, Volodymyr Maibozhenko, from custody on his own recognizance.
