MPs want to ease administrative penalties for tax evaders and encourage them to apply to the TCC

The Parliament has been proposed to consider a draft law amending the Code of Ukraine on Administrative Offences to improve the mechanisms for bringing people to administrative responsibility for violating the rules of military registration and legislation on defence, mobilisation training and mobilisation. The relevant decision was made by the Verkhovna Rada Committee on Law Enforcement, Komersant ukrainskyi reports.

As you know, failure to provide personal data within the specified period without valid reasons is an administrative offence punishable by a fine of UAH 17,000 to UAH 25,500. It is proposed to provide violators with the opportunity to independently apply to the TCC and JV to clarify personal data, while paying a fine of 50% of the minimum amount specified in the relevant article of the Code of Administrative Offences.

Why there is a need to adopt such a draft law

As stated in the explanatory note to the draft law, in 2024, more than 6,000,000 citizens liable for military service did not update their personal data through the administrative service centre or through the electronic office of a conscript, person liable for military service, reservist, or in the district (city) territorial centre for recruitment and social support within 60 days from the date of entry into force of the decree of the President of Ukraine on the announcement of mobilisation approved by the Verkhovna Rada of Ukraine. Failure to provide personal data within the specified period without valid reasons is an administrative offence (Articles 210, 210-1 of the Code of Administrative Offences), which is punishable by a fine of UAH 17,000 to UAH 25,500.

This means that as of today, the Unified State Register of Conscripts, Persons Liable for Military Service and Reservists does not contain complete information on the personal data of a large number of citizens liable for military service, which certainly does not facilitate the mobilisation process in the country.

What this draft law will solve

The adoption of the draft law will encourage persons liable for military service to update their data through the electronic office of a conscript, person liable for military service, or reservist.

In addition, the amendments proposed by the draft law will simplify the procedure for reviewing administrative offences under Articles 210 and 210-1 of the Code of Administrative Offences and enable citizens who have not updated their data without valid reasons to pay 50% of the minimum sanction of the article (UAH 8,500) by independently initiating the process of reviewing the case and imposing a penalty through the Electronic Account of a person liable for military service, conscript, or reservist.

Also, since it is assumed that the clarification of personal data will be a prerequisite for economical booking and use of other important functions of the Electronic Cabinet, it is expected that a large number of citizens liable for military service will take advantage of this opportunity.

In addition, as stated in the explanatory note to the draft law, its adoption will contribute to the state budget through the voluntary payment of fines for administrative offences.
