Experts sound the alarm over the closure of information on electricity trading: a new opportunity for fraud

Ukraine has closed information on electricity trading due to martial law. At the same time, market participants and experts are already criticizing this decision, "Komersant Ukrainian" reports.

“Taking into account the martial law in the country and the enemy’s attempts to destroy our energy infrastructure, Market Operator JSC stops publishing information on electricity trading on the day-ahead and intraday markets on its website and telegram channel,” Market Operator said.

TheUkrainian Energy Exchange reported that the information was closed due to the order of the Minister of Energy No. 27-dsk (for official use) of December 27 for the duration of martial law and until the last day of the month following the month of termination or lifting of martial law.

Market participants and experts criticized this decision.

“What understanding? There is none! Why do this? How does this affect martial law?” Denys Sakva, an energy sector analyst at Dragon Capital, wrote on Facebook.

“How to kill the electricity market and create another opportunity to steal billions of hryvnias… There were few scandals about the completion of units at KhNPP. There were few scandals about where tens of billions of hryvnias from the 70% price increase for the population went… Now the scheming on the electricity market will begin..
Halushchenko is breaking through the next bottom,” former GTSOU board chairman Serhiy Makohon criticized on Facebook.

Nuclear safety expert Olha Kosharna noted that “in violation of the law ‘On the Electricity Market’, this stupid and harmful decision was made for the energy security of the state.”

“How else can the ‘big nuclear construction’ with Russian reactors be pushed through? Not to mention the absurdity that was put into the president’s ears: “by the end of 2024, we will have up to 1 GW of shunting gas generation, and in the following years – another 4 GW.” (June 2024). And what do we have today? Barely 200 MW, which were installed thanks to USAD’s assistance to regional heating companies, private business initiatives and communities…” the expert wrote.

Yuriy Sakva, First Deputy Chairman of the All-Ukrainian Energy Assembly, noted that after almost four years of martial law, transparency in the DAM and the direct contract market has been tightly closed.

“No one has canceled the law on the electricity market. Instead, after almost four years of martial law, transparency on the DAM and the direct contracts market has been tightly closed. The Law on the Electricity Market establishes the following mandatory principles of the electricity market: TRANSPARENCY (the term is used 34 times in the text of the law), NON-DISCRIMINATION (46 times), SEPARATION (60 times), INDEPENDENCE (67 times),” he wrote on his Facebook page.

He emphasized that transparency is a basic principle.

“Without transparency, all other principles lose their original meanings. And the electricity market is moving into the “gray zone” of a trampled half-living law. We need to have some new and very compelling reasons at the state level to ignore the possible consequences and make a decision that has all the signs of violating the law. What are these reasons? No decent ideas. It would be better if it turned out to be a fake,” he summarized.

Oleksiy Kucherenko, MP of the Verkhovna Rada of the 3rd, 5th, 6th and 9th convocations, Minister of Housing and Communal Services (2007-2010 ), noted in his comments that no market can exist without powerful institutions that monitor it, regulate it and make it a real market.
