Former Deputy Head of the SFS illegally wrote off UAH 641 million in taxes: details of the case

The National Anti-Corruption Bureau of Ukraine (NABU) and the Specialized Anti-Corruption Prosecutor’s Office (SAP) have served a notice of suspicion to the former first deputy head of the State Fiscal Service (SFS) of abuse of office, which caused losses to the state of more than UAH 641 million. This was reported by "Komersant Ukrainian" with reference to the NABU press service.

The NABU does not name the suspect, but according to Slovo i Dilo, the former first deputy head of the State Fiscal Service, Sergiy Bilan, was suspected .

How did the scheme work?

According to the investigation, one of the business entities appealed the decision to collect taxes to the SFS.

The suspect, having the exclusive right to sign decisions based on the results of complaints and acting in the interests of the business entity, deliberately failed to sign the finished draft of the relevant decision within the established time frame.

As a result, the complaint was automatically sustained, and the budget lost the opportunity to collect taxes and penalties in the amount of over UAH 641 million.

The actions of the former official are qualified under the Criminal Code

According to the NABU, the former official’s actions fall under Part 2 of Article 364 of the Criminal Code of Ukraine (abuse of power or position).

The sanction of this article provides for punishment in the form of imprisonment for a term of 5 to 8 years with a ban on holding certain positions for up to three years.

What’s next?

Investigative actions aimed at establishing all the circumstances of the case and possible accomplices in the crime are currently underway.

If the former deputy head of the SFS is found guilty, he faces a real prison term.
