The Cabinet of Ministers has updated the rules for reservations for mobilization: details

Starting in December, reservations for persons liable for military service will be made through the Diia app. This is stated in the resolution of the Cabinet of Ministers, which was adopted on Friday, November 22, "Komersant Ukrainian" reports
The document states that from now on, reservations for persons liable for military service will be made through Diia based on electronic lists.
It also stipulates that in order to obtain the status of “critical”, enterprises must provide a certificate of no tax and budget contributions debts.
In addition, state-owned and municipal enterprises are obliged to pay employees at least the average salary for the fourth quarter of 2021 (according to the State Statistics Service – ed.), and private enterprises must provide a salary of at least 2.5 minimum wages to a booked employee.
In addition, the status of a critical enterprise will be coordinated with the Ministry of Economy and the Ministry of Defense, taking into account the needs of local communities. The bodies that determine the enterprises as critical will be obliged to monitor their compliance with the criteria on a quarterly basis.
The new booking procedure will be effective from December 1, and all those who already have deferrals will have a transition period to the new conditions until February 28.
Deferrals will be canceled in the event of:
- expiration of their validity period;
- the enterprise, institution, organization completes the production of goods, performance of works and provision of services to meet the needs of the Armed Forces and other military formations;
- deprivation of an enterprise, institution or organization of the status of critical for the functioning of the economy and ensuring the vital activity of the population during a special period by the body that made the decision to determine such enterprises, institutions and organizations as critical for the functioning of the economy and ensuring the vital activity of the population during a special period;
- liquidation of a state authority, other state body, local self-government body, enterprise, institution or organization;
- dismissal of a person liable for military service from a state authority, other state body, local self-government body, enterprise, institution or organization (except for dismissal with subsequent appointment to another position within the same state authority, other state body, local self-government body, enterprise, institution or organization);
- temporary termination of the employment contract of a person liable for military service with an enterprise, institution or organization;
- a substantiated request from the head of a state authority, other state body, local self-government body, enterprise, institution or organization;
- granting a deferral for other reasons specified in Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”;
- termination of the concluded agreement (contract) or expiration of the term of appointment – for employees of specialized UN agencies, international judicial bodies, international and non-governmental organizations and institutions, where Ukraine is a member, participant or observer in accordance with the international agreements concluded by Ukraine;
- failure of the mine action operator to carry out demining (humanitarian demining) works within six months according to a certified process (processes) based on information provided by the Mine Action Center.

Criteria for enterprises critical to the economy
The Cabinet of Ministers Resolution No. 76 defines the criteria by which an enterprise is recognized as critical to the functioning of the economy and the livelihood of the population during a special period:
- the total amount of taxes paid exceeds the equivalent of EUR 1.5 million;
- the amount of foreign currency revenues exceeds the equivalent of EUR 32 million;
- the company is of strategic importance for the economy and security of the state according to the list;
- the company is important for a sector of the national economy or for meeting the needs of the territorial community;
- no arrears in the payment of a single contribution to the obligatory state social insurance;
- the average salary of the insured employees at the enterprise for the last calendar quarter is not less than the average salary in the region for the fourth quarter of 2021;
- the company is a resident of Diia City.
An enterprise is recognized as critical if it meets at least three criteria. Such enterprises can book 50% of their employees, or more “in case of a justified need”.
