The Cabinet of Ministers has updated the procedure for exporting rapeseed and soybeans without paying customs duties

The Government of Ukraine has clarified the procedure for exporting soybeans and rapeseed, according to which producers of rapeseed and soybeans can export their own crops without paying an export duty of 10%. The relevant Resolution of the Cabinet of Ministers of Ukraine No. 1256 dated October 3, 2025 was published on the Government Portal, "Komersant Ukrainian" reports.

The document, in particular, stipulates that agricultural producers, as well as agricultural cooperatives that export their own grown soybeans and rapeseed, must obtain an export certificate of origin from the Ukrainian Chamber of Commerce and Industry (CCI) or regional CCIs for each batch of exported products.

The above mechanism does not apply to export operations carried out on the basis of intermediary service agreements (in particular, commission, consignment, commission, agency agreements) and to agricultural cooperatives established and/or registered after the entry into force of Article 11 of the Law of Ukraine “On the Rates of Export Duty on Seeds of Certain Types of Oilseeds”.

The government also instructed the Ministry of Economy, Environment and Agriculture to develop and implement monitoring of the compliance of the information contained in expert opinions with the information contained in the State Agrarian Register, taking into account the volume of agricultural products exported with the export duty exemption.

According to Taras Vysotsky, Deputy Minister of Economy, Environment and Agriculture of Ukraine, after the resolution comes into force (from the moment of its official publication) and until December 1, all agricultural producers intending to export soybeans and rapeseed must register the size of the area under these crops and their yield (which should not exceed 3.5 tons per hectare). At the same time, exports of exported products should not exceed their actual production.

He also clarified that the refund of the duty already paid to agricultural producers is not a matter of this resolution and will require a separate legislative decision.
