The Cabinet of Ministers approved a new procedure for issuing subpoenas: why and what will change for Ukrainians

The Cabinet of Ministers of Ukraine has adopted a resolution that changes the procedure for issuing and delivering summonses to citizens. MP Oleksandr Fediyenko wrote about this on September 9 in his Telegram channel, "Komersant Ukrainian" reports.
The document aims to centralize the process, digitalize it and eliminate legal gaps that allowed avoiding the subpoenas.
Centralized printing and state-owned enterprises
From now on, not only territorial recruitment centers (TCCs) will print summonses, but also the Ministry of Defense, regional TCCs and state printing enterprises of strategic importance. This will allow the process to be scaled up and made more controlled.
Use of state registers
Another innovation concerns digitalization. Summonses will be generated automatically based on data from state registers. Thus, information about persons liable for military service will be taken directly from electronic databases, not from paper records. This simplifies the procedure and minimizes the risk of errors.
The role of Ukrposhta
Ukrposhta or another designated postal operator will become the official delivery operator. From now on, summonses will be sent by registered mail. For this purpose, the TCC and the Ministry of Defense must conclude appropriate agreements with the postal operator. The costs of such services may become an additional burden on the budgets of military departments.
Delivery of subpoenas and legal changes
Previously, sending subpoenas by mail was considered an auxiliary mechanism. This created legal disputes: lawyers in courts argued that a citizen did not receive the letter, refused it, or did not pick it up from the post office. Now, it is legally enshrined that a registered letter with a summons is equivalent to official service. Thus, gray areas in the law will be eliminated.

Mass mailings without gaps
The new system opens up opportunities for mass mailing of subpoenas through postal channels. At the same time, the mechanism prevents situations where persons liable for military service formally avoid receiving documents.
That is, a clear legislative mechanism has been introduced that makes it possible to make mass mailings and makes it impossible to avoid delivery through the mail,” Fediyenko emphasized.
