KIK-2026: Tax authorities remind businesses of deadlines for foreign companies

26 February 04:08

In 2026, controlling persons of controlled foreign companies (CFCs) must submit reports for the 2025 reporting year within the time limits specified by law. This was announced by the State Tax Service of Ukraine, according to "Komersant Ukrainian".

The reporting obligation is provided for in Article 39² of the Tax Code of Ukraine and applies to legal entities and individuals who are residents of Ukraine and are recognized as controlling persons with respect to CFCs.

Who must submit a CFC report

The following entities are required to submit reports:

  • Ukrainian legal entities — controlling persons of CFCs;
  • individuals who are residents of Ukraine and have control over foreign companies.

The report is submitted separately for each controlled foreign company.

Key deadlines for submission in 2026

For legal entities

The report for 2025 must be submitted by March 2, 2026, together with the corporate income tax return.

For individuals

The CFC report for 2025 must be submitted by May 1, 2026, together with the annual declaration of assets and income.

If a condensed report is submitted

If it is impossible to prepare the CFC financial statements in a timely manner, it is permissible to submit an abbreviated form of the report.

However, in this case, the full report must be submitted by December 31, 2026 (based on the results of 2025).

Notification of changes

For each:

  • acquisition of control over a CFC;
  • change in shareholding;
  • termination of control —

must be reported to the State Tax Service within 60 calendar days.

What documents are attached to the report

Certified copies of the financial statements of the controlled foreign company must be attached to the report.

The tax service emphasizes that the reporting must be complete and accurate, as financial liability is provided for failure to meet deadlines or failure to submit reports.

What is important to consider in 2026

  • The report is submitted separately for each CFC.
  • The deadlines for legal entities and individuals are different.
  • Submitting an abbreviated form does not exempt you from the obligation to submit a full report.
  • It is important to report changes in ownership structure in a timely manner.

Experts advise not to delay the preparation of documents, as the preparation of financial statements for foreign companies can take a significant amount of time.
