DOT’s billion-dollar catering contract stands up in court: Asix Group loses to Good Food

On May 21, the Kyiv Commercial Court ruled in favor of the State Operator of the Logistics (DOT) in a case challenging a contract for the supply of food to the Armed Forces. The court rejected the claims of Asix Group, which tried to cancel the UAH 1.1 billion deal between the State Logistics Operator and Good Dish LLC, "Komersant Ukrainian" reports.

The subject of the dispute was the purchase of sets of food and dried products for military units and educational institutions of the Armed Forces of Ukraine for 2025, ordered at the end of 2024. The plaintiff argued that the winning bidder did not meet the technical requirements of the tender, in particular, the availability of a qualified IT specialist and warehouse staff.

However, the court found that the head of the IT department of “Good Dish” had the necessary qualifications to perform the functions of an IT specialist. The judges also found no violations in the documentation of the warehouses and recognized that not all employees are required to be assigned to specific warehouses. In addition, the court noted that Asiks Group had chosen an ineffective remedy.

“Asix Group and “Good dish”

Kyiv-based Asix Group is headed by Yevhen Lazorenko from Zaporizhzhia. The company’s management has changed several times: until the beginning of 2024, Vadym Kvyatkovskyi was the founder and director, and until December 2022, Yevhen Bilyi held this position.

The company has a problematic history with defense contracts. According to StateWatch, the Kyiv Commercial Court has previously established the facts of the supply of low-quality food products by this company to military units.

As for the winner of the tender, LLC “Garna Strava”, its founder is Yevhenia Shelest. The company leases warehouse space from Sherry Impex, a private enterprise owned by Serhiy Sharkun, a former deputy of the Novomoskovsk City Council from the Batkivshchyna party.

In 2023, “Garna Strava” was investigated by Bihus.Info for suspected overpricing of food for the army. The journalists found a significant difference between the company’s purchase prices and the cost of deliveries to the Ministry of Defense: for potatoes – 16.5-19.8 UAH per kilogram, for cabbage – from 20.5 UAH, for beets – at least 19 UAH per kilogram.
