The Ministry of Defense is tightening requirements for defense contractors

The Ministry of Defense of Ukraine has tightened the rules for companies that fulfill defense contracts if they have debts and enforcement actions are suspended against them during martial law.
This is reported by "Komersant Ukrainian" with reference to the government portal.
From now on, another criterion is additionally taken into account: more than half of the company’s products, works or services must be for defense purposes.
The changes were introduced in December 2025. The Cabinet of Ministers adopted a resolution that clearly regulates the procedure for identifying defense companies whose debts suspend enforcement actions during martial law.
After the liquidation of the Ministry of Strategic Industries, these powers were transferred to the Ministry of Defense.
Practice has shown that it is necessary to clearly identify enterprises for which defense production is the main activity, the Ministry of Defense said in a statement. Therefore, the Ministry’s experts have made appropriate changes to the rules.
From now on, in order for a company to be a defense contractor, it must simultaneously meet three conditions:
- Execute a state defense contract, including foreign economic contracts.
- Be included in the electronic register of participants and executors of state contracts.
- Produce more than 50% of its products or provide more than 50% of defense services.
Currently, the list of such enterprises whose debts are subject to enforcement actions during martial law includes 51 companies in the defense industry.
Audit in the defense sector
As a reminder, Prime Minister Yulia Svyrydenko said that in December 2025, audits in the defense sector and inspections of state-owned enterprises of the Ministry of Defense would begin.
According to her, in the second half of December, 22 enterprises of the Ukrainian Defense Industry JSC, as well as state-owned enterprises Defense Procurement Agency and State Logistics Operator will be inspected for the period of 2022-2025. The first results of the inspections are expected in January.
