A 20% salary bonus: Which Ukrainians are eligible for the bonus?
26 March 04:00
Some Ukrainians may be eligible for a higher wage—at least 20% more per hour worked. This applies to employees who work night shifts. This provision is stipulated by Ukrainian labor law. The Pension Fund of Ukraine has issued a reminder of this, according to "Komersant Ukrainian"
Who is eligible for the 20% wage supplement
According to the Labor Code of Ukraine, employees who work night shifts are entitled to a premium. The minimum amount of this premium is at least 20% of the standard hourly rate for each hour of night work.
This rule applies to all employees who officially work the night shift.
What time is considered nighttime
The law defines nighttime as the period:
- from 10:00 PM to 6:00 AM.
It is precisely the hours worked during this period that are paid at a higher rate.
How is the night shift premium calculated
The premium is calculated based on:
- time sheets;
- actual hours worked;
- the terms of the collective bargaining agreement.
At the same time, 20% is the minimum guarantee. The employer may set a higher premium.
Is the night shift shortened?
According to the law, the duration of night work is usually reduced by one hour.
However, this rule does not apply:
- if the employee already has reduced working hours;
- in continuous production;
- for shift work;
- during martial law (in certain cases).
Who Cannot Be Assigned to Night Work
The law establishes restrictions on night work. The following individuals may not be assigned to night shifts:
- pregnant women;
- women with children under 3 years of age;
- persons under 18 years of age.
People with disabilities may work at night only:
- with their own consent;
- if it does not conflict with medical recommendations.
Can women work at night?
Women may be assigned to night work only when production necessitates it and in accordance with the law. However, there are exceptions for family-owned businesses.
What employees need to know
Experts advise employees to pay attention to the following points:
- whether the employer is correctly tracking night hours;
- whether the employment contract or collective bargaining agreement provides for additional pay;
- whether the salary meets legal requirements.
If night hours are not properly compensated, the employee has the right to contact the State Labor Service.
Could labor compensation rules change?
Ukraine is also in the process of drafting a new Labor Code, which could change the rules governing the labor market.
The document is expected to modernize labor relations and adapt them to current conditions.
