New fines for violation of customs rules – the law has been signed

President Volodymyr Zelenskyy has signed a law amending the Customs Code to make it more accountable for violations of customs rules. Document No. 10257 has already been returned to parliament with the signature of the head of state. This is evidenced by the information in the bill’s card, "Komersant Ukrainian" reports

The law was adopted on March 25.

It was developed to implement the decisions of the Constitutional Court, which declared a number of articles of the Code unconstitutional.

According to the new rules:

  • fines will be determined differentially – a fixed amount if the decision is made by customs, and a range of minimum and maximum fines if the decision is made by the court (as required by the CCU)
  • the mandatory confiscation of vehicles used during the violation was canceled – the court will decide on the penalty itself;
  • a fine for violations in postal items (30-50% of the value of the goods) with the possibility of confiscation was introduced. Previously, only confiscation was provided for.

The law also establishes a penalty for the importation of goods in violation of intellectual property rights (except for personal use) in the form of a fine of one thousand to two thousand tax-free minimum incomes with confiscation of such goods.

The Law also regulates the terms of consideration of appeals against decisions in cases of violation of customs rules, expands the rights of business entities to appeal against decisions of the Customs, expands the list of authorities entitled to carry out customs clearance of military equipment and other goods transported using Form 302, and expands the rights to suspend the granting of tariff benefits (preferences) to goods originating from a state with which Ukraine has concluded a relevant international free trade agreement.
