Odesa court sentences woman for pornography under 1923 law

The Odesa District Court convicted a woman for publishing pornographic content, citing the 1923 international convention, which Ukraine has never signed. This was reported by the Better Regulation Delivery Office (BRDO), according to "Komersant Ukrainian".
According to the case file, the defendant created and posted pornographic photos and videos on the Telegram messenger for a fee. The court issued a guilty verdict based on the International Convention for the Prevention of the Circulation of Pornographic Publications of 1923.
However, as it turned out, Ukraine is not a signatory to this Convention, according to the UN depositary. This was confirmed by the UN Secretariat in a response to the Ministry of Foreign Affairs of Ukraine back in 2023.
“Ukrainian courts pass sentences referring to legal norms that do not apply in Ukraine. Over the past three years, there have been about 40 verdicts on pornography with the same charges. That is, some judges don’t even want to justify why they recognize a person as a criminal. And they judge people for acts that do not pose a public danger,”
– said BRDO representative Ihor Samokhodskyi, Head of the ICT Sector at the BRDO.

In addition to the invalid convention, the court also referred to the Law of Ukraine “On Protection of Public Morality,” which had expired more than a year before the offense was committed, and the European Convention on Transfrontier Television, which does not regulate content in messengers.
The court sentenced the woman to a 3-year prison term, but released her from serving it with a 1-year probationary period.
According to the BRDO, in the first 9 months of 2024, 1104 indictments for pornography were filed with Ukrainian courts, which is 75% more than in the same period in 2023.
As reported by , law enforcement agencies continue to spend resources on prosecuting Ukrainians for sharing intimate photos and videos. For example, the BES recently raided OnlyFans models who had registered and paid taxes.
