Pensions for prosecutors: Rada promotes new rules for payments and recalculations

The Verkhovna Rada Committee on Social Policy has recommended that the parliament adopt as a basis the revised draft law No. 12278 on pensions for prosecutors. Earlier, the document was returned for revision, in particular, taking into account the proposals of the committee’s chairwoman Galina Tretyakova, "Komersant Ukrainian" reports.
What is the purpose of the draft law?
The draft law aims to:
- to unify approaches to pensions for prosecutors;
- ensure compliance of the conditions for granting and paying pensions with national standards;
- introduce transparent mechanisms for calculating and recalculating pensions.
How will the pension payment procedure change?
According to the new version:
- long-service pensions will be paid only after dismissal from the position that gives such a right;
- in case of employment for a similar position, the pension payment is suspended;
- upon dismissal, it will be resumed.
Who retains the right to receive a pension while working?
Exceptions apply to:
- persons with disabilities of groups I-II;
- participants in military operations;
- persons covered by paragraph 1 of Article 10 of the Law “On the Status of War Veterans”.
How will the recalculation be carried out?
Pensions granted in accordance with this law will be recalculated annually from March 1, taking into account
- growth in personal income;
- the consumer price index;
- the increase coefficient determined by the Law “On Compulsory State Pension Insurance”.
What sources are taken into account when calculating length of service?
Length of service includes:
- work in research and educational institutions of the Prosecutor General’s Office;
- military service;
- half of the period of full-time study in law schools.
What innovations are envisaged for people with disabilities?
Prosecutors with disabilities will be granted a pension under the general system – in accordance with the Law “On Compulsory State Pension Insurance”.
How will appeals against decisions be organized?
Appeals against decisions to grant or recalculate pensions will be made in accordance with the provisions of the Law on Administrative Procedure, taking into account the provisions of pension legislation.
Which bodies will be involved in the implementation?
The draft law provides for granting the Pension Fund the status of a central executive body; instructing the Cabinet of Ministers to develop proposals for unifying the remuneration of prosecutors by December 2025.
