Rada plans to increase fines for speeding: details

A bill has been registered in the Verkhovna Rada that proposes to change the approach to liability for speeding, "Komersant Ukrainian" reports

In particular, the authors of the initiative want to abolish the so-called “non-financial minimum” of 20 km/h and introduce a new, more detailed scale of liability.

According to the current legislation, liability is only provided for speeding from 20 to 50 km/h (a fine of UAH 340) and over 50 km/h (a fine of UAH 1700). At the same time, speeding by less than 20 km/h is effectively ignored by the law.

“The Code of Administrative Offenses provides for fines for speeding by 20 km/h or more. This approach actually encourages drivers to drive 20 km/h over the speed limit. Among Ukraine’s neighboring countries and EU member states, only the Russian Federation has such a “permitted” speed limit of 20 km/h,” the explanatory note says.

If the new draft law is adopted, liability will begin with exceeding 10 km/h. It is proposed to introduce six levels of penalty depending on the level of exceeding the speed limit:

  • over 10 km/h – UAH 340
  • over 20 km/h – UAH 680
  • over 30 km/h – UAH 1360;
  • over 40 km/h – UAH 1700;
  • over 60 km/h – 2720 UAH;
  • over 80 km/h – 3400 UAH.
  • Speeding over 80 km/h, which caused an emergency situation, will result in deprivation of the right to drive for a period of 6 months to 1 year.

These changes are envisaged by the new Article 122⁶ of the Code of Ukraine on Administrative Offenses (CAO), which is proposed to be added to the legislation. The authors of the draft law point out that the current fines do not comply with the principle of proportionality.

Under the current legislation, speeding by more than 20 km/h is currently punishable by a fine of UAH 340. Instead, if the speed limit is exceeded by more than 50 km/h, the fine will be UAH 1,700.

The permitted speed in urban areas in Ukraine is 50 km/h, while on most country roads it is 90 km/h or 110 km/h.
