Russian propagandist’s legal rights finally restricted in Ukraine

Russian propagandist and until recently still a Ukrainian lawyer Tatiana Montyan has finally been disbarred from practising law in Ukraine, Komersant ukrainskyi reports.

However, when reporting the fact of disbarment, the Office of the Prosecutor General of Ukraine did not name the lawyer. However, they filled this information gap with a photo, from which it can be concluded that it is Montyan.

The OGPU reminded that back in March 2023, prosecutors sent an indictment to court against a Russian propagandist who was a lawyer.

The delay in the relevant decisions in the notification is apparently due to the fact that, in accordance with Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until his or her guilt is proved in accordance with the law and established by a court verdict.

What is Tatiana Montyan charged with?

The propagandist is accused of making public calls for the violent change or overthrow of the constitutional order of Ukraine, the seizure of state power of Ukraine, changing the boundaries of the territory and state border of Ukraine, public denial of the armed aggression of the Russian Federation against Ukraine, as well as justification of war (Articles 109, 110, 111-1, 436-2 of the Criminal Code of Ukraine).

In February last year, the Security Service of Ukraine served a notice of suspicion to Tatiana Montyan, who, according to the special service, is actively involved in Russia’s information and psychological special operations.

What the investigation has already revealed

The investigation established that the accused, after the start of Russia’s full-scale invasion of Ukraine, since March 2022, has been systematically speaking out on propaganda channels about the socio-political situation in Ukraine.

Ideologically justifying the existence of the self-proclaimed republics, she justified Russia’s armed aggression. She publicly called for a violent change or overthrow of the constitutional order of Ukraine, changing the boundaries of the territory and state border of Ukraine.

According to the investigation, Montyan left for Russia back in 2021, and since then she has been constantly visiting the temporarily occupied areas of Donetsk and Luhansk regions.

And now the decision has finally been made. Apparently, it is not the last one in this case.

Following a complaint from the Prosecutor General’s Office, the Qualification and Disciplinary Commission of the Zhytomyr Oblast Bar Association disbarred the lawyer.
