According to the law No. 10449 on mobilisation, all conscripts, persons liable for military service and reservists must report to the military registration and enlistment office, the Centre for Administrative Services or use an electronic cabinet within 60 days from the date of entry into force of the law (due to start on 18 May) and undergo verification of personal data. [ Kommersant asked Kateryna Anishchenko, a lawyer at Riyako&Partners, what will happen if you do not register for military service and what penalties you will face in case of violation of military registration.

What happens if you do not register for military service?

on 18 May, the law comes into force, and persons liable for military service have 60 days to organise their thoughts on this matter. Thus, roughly speaking, the deadline expires on 16-17 July. Although the law provides for administrative liability and increased fines, no one removes the issue of repetition. The issue of repeat offences is a matter of criminal liability.

Therefore, it is possible that the issue of criminal liability will be considered for the second or third failure to appear. For now, this is administrative liability, and in the future, the TCC may apply to the court to restrict the right to drive a vehicle and impose the fine itself through the court.

In the future, this resolution will be submitted to the executive service authorities, and the state executive service has the right to seize card accounts and write off funds from these card accounts in order to enforce the court decision.

What is the fine?

Starting from 18 May, it will be from UAH 17,000 to 29,000, and up to UAH 50,000 for a repeat offence. For legal entities, this amount is much higher.

What if I don’t update my data?

In fact, updating data is the same responsibility if you don’t do it. Moreover, given the fact that the law is coming into force and in accordance with the requirements of this law, a man will not be able to use any services as in normal life. Because from 18 May, a person liable for military service must have a military ID card. In addition to the passport.

Thus, a passport and a military ID card give you the right to use any services.

So, if you don’t register by 16-17 July, you’ll face a fine of UAH 17,000 or more?

The TCC has the right to apply to the court, first send a summons to the last known place of registration, and then send a demand – this is a different document than a summons – for mandatory attendance at the TCC to update data or register. In the future, the issue of administrative detention will be considered.

And we understand that if, for example, there is an administrative detention and a person is driving a vehicle, they will be stopped, simply taken out of the car and brought to the TCC.
