Transfer pricing fines with 50% discount: who will be affected by the new law

President of Ukraine Volodymyr Zelenskyy has signed Bill No. 12093, which defines mechanisms of administrative liability for violation of military registration rules. This was reported by Deputy Minister of Defense for Digital Development, Digital Transformation and Digitalization Kateryna Chernogorenko, "Komersant Ukrainian" reports

“The President signed the bill No. 12093! Thank you for your support!…Servicemen who defended the country and did not have time to update their data are exempt from paying fines. This is fair. And civilians will have a convenient opportunity to pay a fine with a 50% discount to the Reserve. The team is already working on it. Expect it in the summer,” Chernogorenko wrote.

By the way, this law proposes a number of other innovations that are unlikely to appeal to Ukrainians who avoid visiting transfer pricing centers and joint ventures. Kommersant Ukrainsky analyzed in detail what pitfalls the document contains.

What is known about the draft law

The Verkhovna Rada passed the law “On Amendments to the Code of Ukraine on Administrative Offenses to Improve Mechanisms for Bringing Persons to Administrative Liability for Violation of the Rules of Military Registration and Legislation on Defense, Mobilization Training and Mobilization” on March 13.

The purpose of the draft law is to improve the mechanism of bringing to justice for violations of military registration, to encourage citizens to update their data through an electronic cabinet and to fill the budget through voluntary payment of fines with a 50% discount.

In particular, this law proposes to allow a person brought to administrative responsibility to voluntarily pay 50% of the amount of the fine imposed within 10 calendar days from the date of entry into force of the resolution.

Persons liable for military service will be able to pay such a fine with a 50% discount in the Reserve application. And servicemen who have also committed violations will be completely exempted from payment.

Persons liable for military service will be able to:

  • Submit an application to the Reserve stating that they recognize the violation.
  • Next, they will be able to receive a decision on this violation right in the app.
  • And finally, pay the fine with a 50% discount.

Fines from the TCC can be paid online

The day before, Deputy Minister of Defense of Ukraine Kateryna Chernogorenko explained that the fine for untimely updated data can be paid through the Reserve app.

Ukrainian citizens abroad will also be able to pay the fine for unupdated data online, and this, according to the Deputy Minister of Defense, will allow Ukrainians to return home without violations.

For military personnel, fines for such violations will be completely canceled.

Ukrainians are not in a hurry to pay fines from the TCC

Since the beginning of the year, about 10 thousand proceedings have already been opened for unpaid fines – almost as many as for the entire year of 2023. Such data is provided by the Opendatabot service. Kommersant Ukrainian also reported on this.

Almost half of the overdue fines this year were issued to Ukrainians aged 25-35. Another 38% of proceedings are for people aged 36-45.
