“Official negligence”: how a Defense Ministry official caused UAH 275 million in losses to the state

During 2022-2023, a former senior official of the Ministry of Defense of Ukraine unlawfully included VAT in 8 state contracts totaling about UAH 3.1 billion, which resulted in losses to the state budget of more than UAH 275 million. Now he has been notified of suspicion of gross negligence that caused grave consequences and of using knowingly forged documents. This was reported by the Office of the Prosecutor General of Ukraine, "Komersant Ukrainian" reports.
According to the investigation, the former deputy director of a department of the Ministry of Defense, when concluding state contracts, contrary to the requirements of the Cabinet of Ministers Resolution No. 178 of March 2, 2022 and Article 195 of the Tax Code of Ukraine, illegally included value added tax in the amount of contracts.
Such actions are qualified as official negligence that caused serious consequences, as well as the use of knowingly forged documents.

Therefore, the official was served a notice of suspicion under Part 2 of Article 367 and Part 4 of Article 358 of the Criminal Code of Ukraine.
The pre-trial investigation is being carried out by SBI investigators under the supervision of prosecutors of the Prosecutor General’s Office.
In the course of the pre-trial investigation, the business entities have already reimbursed more than UAH 201 million in damages to the state.
