Cases involving MPs in the High Anti-Corruption Court: what an analysis of court decisions over five years has revealed

Criminal proceedings were opened against at least 35 members of the Verkhovna Rada of the IX convocation in 2021–2026, which were considered by the High Anti-Corruption Court or its Appeals Chamber.

These are the results of an analysis by YouControl analysts and lawyers, who studied court decisions based on data from the Unified State Register of Court Decisions and the Judicial Power of Ukraine portal, reports "Komersant Ukrainian".

The study covers cases involving current and former deputies, with the exception of those who have died, and is based exclusively on court decisions — that is, it does not reflect all cases of suspicion being announced if no procedural decisions were made in relation to them.

Information source and scope of analysis

The impetus for the study was an interview given by the head of the Specialized Anti-Corruption Prosecutor’s Office, Oleksandr Klymenko, to the Ukrinform agency, in which he reported that 41 deputies of the IX convocation had been charged.

YouControl emphasizes that the USRDP contains only court decisions, so the actual number of suspected deputies may be higher.

Who is involved in the proceedings

Of the 35 MPs included in the sample, 28 are currently in office.

The largest number of suspects are among the representatives of the Servant of the People faction: 20 MPs are or were members of this political force.

The following also appear in the court decisions of the High Anti-Corruption Court and its Appeals Chamber:

  • 4 deputies from the For the Future Party group;
  • 3 from the “Restoration of Ukraine” faction;
  • 2 from European Solidarity, Batkivshchyna, and the DOVIRA deputy group;
  • 1 independent MP;
  • 1 former deputy from the now-banned Opposition Platform — For Life party.

Cases involving independent MP Viktor Bondar and former OPFL MP Andriy Derkach are currently being considered by the Appeals Chamber of the High Anti-Corruption Court.

Which articles of the Criminal Code appear most often

In general, proceedings were initiated under seven articles of the Criminal Code of Ukraine.

Inaccurate declarations (Article 366-2 of the Criminal Code)
This article is the most common: it appears in cases involving 13 current and former MPs.
In 10 cases, the proceedings were closed due to the expiration of the statute of limitations.
Two other deputies from the Servant of the People party were released from liability due to “active repentance.”
The case against Serhiy Shakhov (DOVIRA) has been suspended, and the MP himself has been declared wanted.

Appropriation or embezzlement of property (Article 191 of the Criminal Code)
Five people are accused or suspected under this article, including Viktor Bondar, Yaroslav Dubnevych, Robert Horvat, former minister Mykola Solsky, and deputy Oleksiy Kuznetsov.

Obtaining unlawful benefits (Article 368 of the Criminal Code)
The proceedings concern four deputies from the Servant of the People faction and also feature in the case of Oleksandr Yurchenko.

Providing unlawful benefits (Article 369 of the Criminal Code)
Six MPs are being prosecuted under this article, including the head of the Batkivshchyna faction, Yulia Tymoshenko, and a number of current and former MPs.

Illegal enrichment (Article 368-5 of the Criminal Code)
This charge appears in the cases of two deputies from the Servant of the People party, as well as in the case of former deputy Andriy Derkach, along with charges of high treason.

Separately, the sample includes cases of abuse of influence (Article 369-2 of the Criminal Code) and abuse of power (Article 364 of the Criminal Code).

What this picture shows

YouControl analysts do not assess the guilt of the defendants, emphasizing that they are only referring to the existence of court proceedings.

At the same time, the data shows that anti-corruption cases in the High Anti-Corruption Court involve deputies from virtually the entire political spectrum of the Verkhovna Rada of the IX convocation — both current and former.
