Students with “eternal vacations” may lose the right to deferment from mobilization: details of the new draft law are known

ANALYSIS FROM “Procrastinating” or remaining a student because of an academic leave will no longer be grounds for maintaining the deferment. The Parliamentary Committee on National Security and Defense has recommended that the Cabinet of Ministers’ draft law No. 13634 be adopted as a basis. It significantly changes the rules for students and teachers to be deferred from mobilization. The document sparked lively discussions in society. Teachers say that it is a wrong way to remove the deferment from everyone. The problem should be solved by checking the quality of education.
Will the draft law really close the “schemes of evasion” through education, or will it create new problems? Which categories of students may lose their deferment in the near future

Colleges have dramatically increased the number of applicants, and there are 30-, 40-, even 50-year-olds among them. The Ministry of Education and Science considers this a distortion, and it is for this category that the deferral is proposed to be canceled,” Yahodzinsky emphasized.
According to the scientist, the adoption of the bill could have serious consequences.
“If the law is adopted in its current version, it will be quite unwise. After all, it will remove the deferment from many masters and graduate students. This undoubtedly violates people’s right to education and reduces the scientific potential of our country,” says Serhiy Yahodzinsky
The professor emphasizes that the problem can be solved in another way – by checking the quality of education.
The question is not whether there is a deferral, but whether students are actually studying. This can be controlled by the Ministry of Education and Science and the State Quality Service. If universities enroll hundreds of postgraduate students without the conditions for studying, they need to revise their licenses. But I would not recommend blaming people who exercise their constitutional right to education,” Serhiy Yahodzinsky
Removing the deferment from everyone is the wrong way to go, the professor concluded.
What is changing for students
The goal of the initiative is to close the possibility of using education as a way to evade service.
According to the project, only those who
- started studying no later than the year they turned 25;
- are studying full-time or dual enrollment;
- are studying at this level for the first time.
The key innovation is that the deferment will be granted only within the estimated period of study. That is, a sabbatical, repeated course, or expulsion with subsequent reinstatement may result in the loss of the right to deferment.
What changes for researchers and teachers
Doctoral students, medical interns and residents will retain the right to deferment, but only if they are studying for the first time at the appropriate level.
The right to deferment will also be preserved:
- teachers and researchers with a scientific degree;
- teachers of higher and professional higher education institutions
- employees of vocational and general secondary education institutions.
According to the authors of the draft law, the new rules should make it impossible for people to use their student status or “lifelong learning” to avoid mobilization.
