Court accepts Kolomoisky’s appeal: High Court of London ruling suspended

The enforcement of the High Court of London’s decision in the case of PrivatBank’s claim for damages has been suspended pending the outcome of the appeal. This was announced by Alexander Lysak, the lawyer representing Ukrainian businessman Ihor Kolomoisky, according to "Komersant Ukrainian".
According to him, the defense filed an appeal against the decision of the court of first instance in case No. BL-2017-000665, and it was accepted for consideration by the court of appeals.
What does the suspension of enforcement mean?
As the lawyer explained, the appeals court will review all the legal conclusions set out in the High Court of London’s decision. Until this process is complete, enforcement of the decision has been suspended.
“Until the appeal proceedings are completed, the enforcement of the first instance court’s decision will be suspended, as there is a possibility that it will be overturned on appeal,” said the defense representative.
Thus, the High Court’s decision is not yet final, and the further fate of the case will depend on the outcome of the appeal.
Kolomoisky’s position
The businessman’s defense stated that they expect a complete, comprehensive, and impartial review of the arguments on which the court of first instance based its decision.
The lawyer emphasized that the appeal review is an important stage of the judicial process and allows for the verification of both the legal qualification and the factual circumstances of the case.

After considering the appeal, the court may:
- leave the decision unchanged;
- partially change it;
- or overturn it completely and send the case back for a new trial.
