US court rules most of Trump’s tariffs illegal

Most of the tariffs imposed by US President Donald Trump are illegal because he does not have the authority to impose them under the International Emergency Economic Powers Act (IEEPA), the US Court of Appeals for the Federal Circuit ruled on Friday, August 29. “The law grants the president significant authority to take a number of actions in response to a declared national emergency, but none of these actions expressly includes the right to impose tariffs, duties, etc. or the right to impose taxes,” the court said in its decision, according to "Komersant Ukrainian".

Thus, the appellate court largely upheld the decision of the U.S. Court of Federal Claims for International Trade, which ruled in May that IEEPA, which the U.S. president relied on when imposing duties, does not give him “unlimited authority” in this area. In most cases, the US Congress is supposed to make such decisions, according to this provision.

At the same time, the court allowed the tariffs to remain in effect until October 14 to give the Trump administration the opportunity to appeal to the US Supreme Court.
