Court seizes Kyiv college premises from entrepreneur: details

The Commercial Court of Kyiv invalidated the lease agreement for the premises of the Kyiv Professional College of Tourism and Hotel Management, which was concluded between the State Property Fund and individual entrepreneur Viktoria Levitas.

This is evidenced by the court decision of February 2, reports "Komersant Ukrainian" with reference to “EP”.

The case concerns the lease of part of the building on the first floor of the college dormitory with a total area of 52 square meters at the following address: 26 General Zhmakhenko Street (now Prince Roman Mstislavich Street), Kyiv.

In 2022, the regional branch of the State Property Fund in Kyiv held an electronic auction for the lease of this premises, which belongs to the Ministry of Education. It was planned that the purpose of use would be “to house a domestic publishing house that provides for the preparation, publication, and distribution of at least 50 percent of book products in the state language (educational and methodological literature for students).”

Subsequently, the State Property Fund and Levitas signed a 5-year lease agreement worth UAH 42,745.

As it turned out, the lease agreement specified that the premises could be used by the lessee to provide services for the sale of stationery, photocopying, printing, and photography. This is what the entrepreneur was engaged in.

The court found that Levitas was not an educational entity, but rather engaged in economic activities that were not exclusively aimed at serving participants in the educational process. Therefore, it declared the lease agreement invalid.
