Trade with the EU at risk: Parliament assesses draft law on nicotine pouches

The Verkhovna Rada Committee on Ukraine’s Integration into the European Union recommended revising draft law No. 14110-d on the regulation of nicotine pouches, taking into account EU standards and following consultations with the European Commission.

This was reported by "Komersant Ukrainian" with reference to the relevant conclusion of the committee.

The conclusion states that some provisions of the draft law contradict EU law.

For example, it mentions the illogical definition of a nicotine-containing product as a “tobacco product that does not contain tobacco” and other inconsistencies.

Regarding the maximum nicotine level of 1 mg per pouch proposed in the draft law, the committee believes that such a restriction could well become a technical barrier to trade with the EU.

“Setting a nicotine limit of 1 mg, which does not correspond to the standard ranges on the EU market of 3-20 mg, may effectively prevent imported goods from entering the Ukrainian market,” the conclusion states.

Recall that at the end of 2025, the Verkhovna Rada Committee on National Health, Medical Care, and Medical Insurance supported draft law No. 14110-d on the regulation of nicotine pouches and recommended that the Verkhovna Rada adopt it in the first reading as a basis.

The bill provides for a ban on the sale of pouches to minors, a ban on advertising, sponsorship, and promotion, the placement of a medical warning on the packaging covering at least 65% of its surface area, and a maximum nicotine content of 1 mg per pouch.

Subsequently, Ukrainian business associations spoke out against bill No. 14110-d, which effectively introduces a ban on the circulation of nicotine pouches, as this will lead to negative financial and economic consequences and a deterioration in the investment climate.
