Legal classification may change in proceedings against MP Skorokhod — interview

Commenting on the NABU case against her, MP Anna Skorokhod said that the Bureau’s detectives could change the legal classification of the proceedings. She said this in an interview with the YouTube channel "Komersant Ukrainian".

The MP drew attention to the change in rhetoric on the part of law enforcement agencies. According to her, NABU and prosecution representatives are now talking in court not about proven incitement, but only about its possibility, and are also allowing for a change in the legal classification.

“By the way, now in court, both the prosecutor’s office and NABU detectives who attend the hearings say: perhaps incitement was committed. That is, no longer ‘incitement was committed’, but ‘incitement may have been committed’. And when they continued the pre-trial investigation, they noted that one of the grounds for continuing on their part was a possible change in classification. Well, you know, a little asterisk, as they say,” she says.

At the same time, Skorokhod does not rule out that the case may still be referred to court, but she is convinced that from a legal point of view, there are no grounds for prosecution.

“Given how NABU works, it will most likely be referred to court. But if we consider the Criminal Code and the Criminal Procedure Code of Ukraine, there are no grounds for a crime. And if there are no grounds for a crime, it must be closed,” the MP emphasized.

The MP also clarified that the first public information about the case came not from NABU, but from the Security Service of Ukraine (SBU), and admitted that she did not pay attention to it on the first day.

“But after the show that was created, not only by NABU, it should be noted, but also by the SBU. On the first day, I was so emotional that I didn’t notice that the first publication was made by the SBU, not NABU.

In my opinion, the case should be closed. And as many lawyers as have looked at the materials, they do not understand, just like the prosecutors, how such a thing could have been signed,” she concluded.

The Skorokhod case

On December 5, NABU and the SBU came to Anna Skorokhod’s home, after which they announced their suspicion of bribery by a group of individuals. According to the investigation, the deputy allegedly “organized the activities of a criminal group” that offered an entrepreneur $250,000 to negotiate with the National Security and Defense Council on the application of sanctions against a competing company.

Investigators say that the entrepreneur transferred $125,000 in bribes under the guise of a loan, but never received the promised decision from the NSDC. As evidence, NABU and SAP published a video in which Skorokhod allegedly negotiates money in exchange for receipts.

On December 9, the High Anti-Corruption Court chose a preventive measure for Anna Skorokhod in the form of bail in the amount of 3 million 28 thousand hryvnias. On December 12, bail was posted for the MP. She was released with an electronic monitoring bracelet.
