A court in Zaporizhzhia evicted the National Union of Artists from the attic of a municipal building

The Commercial Court of Zaporizhzhia Oblast has ordered the Zaporizhzhia branch of the National Union of Artists of Ukraine to vacate part of the leased attic space in the building of the Zaporizhzhia municipal enterprise “Gradproekt.”
This is evidenced by a court ruling dated March 11, reports "Komersant Ukrainian" with reference to EP.
The ruling concerns the vacating of a 48-square-meter section of the attic in the building located at 151/11 Soborny Ave./Stalevariv St.
The Zaporizhzhia branch of the National Union of Artists of Ukraine has been renting it since 2004, when a corresponding agreement was signed between the Housing Department of the Zaporizhzhia City Council (landlord), the municipal enterprise “Production, Repair, and Maintenance Housing Association No. 13” (“VREZO No. 13,” the balance sheet holder), and the Artists’ Union.
Subsequently, the Zaporizhzhia organization renewed the lease agreement with a number of municipal enterprises that were the legal successors of “VREZO No. 13.”
In 2024, the building at 151/11 Soborny Ave./Stalevariv St. was transferred to the management of the municipal enterprise “Gradproekt.” The municipal enterprise determined that the 2004 lease agreement had expired back in July 2020, yet the artists’ union continued to use the attic.
In 2025, “Gradproekt” asked the association to return the non-residential premises or to provide a justification for why it was impossible to return them from leasehold use.
Since the Zaporizhzhia organization did not respond to the request, the municipal authorities went to court to evict it.
In court, representatives of the Zaporizhzhia branch of the National Union of Artists objected to the lawsuit, requesting that the statute of limitations be applied, which, in their opinion, “Gradproekt” had missed without valid reasons.
Judge Vitaliy Korsun rejected this motion, noting that “the statute of limitations does not apply to claims seeking the removal of obstacles to the exercise of the right to use and dispose of property; such a claim is negative in nature and may be brought by the plaintiff as long as the relevant violation exists.” Therefore, he ordered the vacating of a portion of the attic (lit. A-5) with an area of 48 square meters at Soborny Ave./Stalivaryv St., bldg. 151/11, by evicting the Zaporizhzhia branch of the National Union of Artists of Ukraine.
The Zaporizhzhia branch of the National Union of Artists of Ukraine is headed by Oleksandr Shkalikov, and the head of the municipal enterprise “Gradproekt” is Vasyl Polyusov.
