Government prepares punishment for curfew violation: details

The Cabinet of Ministers has approved a bill that proposes to introduce fines for violating the curfew. This was announced by the government’s representative in parliament, Taras Melnychuk, on Telegram, "Komersant Ukrainian" reports

The draft law proposes to add a new article to the Code of Administrative Offenses of Ukraine, which will establish administrative liability for violating the rules of martial law.

This includes such violations as entering or staying in settlements where mandatory evacuation is underway without special passes or certificates.

The document also provides for liability for violation of the curfew, which is a ban on being on the street or in other public places at a certain time without special permission.

In addition, Article 262 of the Code is proposed to be amended to give the police the right to detain violators.

The specific amount of fines proposed by the government is not yet known.

As of today, violations of the curfew are punishable under the general rules.

In particular, if a person fails to comply with the lawful demands of a police officer, a report is drawn up under Article 185 of the Code of Administrative Offenses (“malicious disobedience”). Under this article, the following penalties are possible:

  • a fine of 136 to 255 UAH;
  • community service: 40-60 hours;
  • correctional labor: 1-2 months with 20% of earnings withheld;
  • administrative arrest for up to 15 days.

There is no special article on fines for curfew violations yet.
