Pregnant Ukrainian women are allowed to divorce, but under one condition

The Verkhovna Rada has adopted in the second reading Bill No. 10249, which expands the list of grounds for divorce during pregnancy and within one year after the birth of a child. This was reported by Inna Sovsun, a member of the Voice parliamentary faction, on the social network X, "Komersant Ukrainian" reports
According to the politician, this was the second attempt to adopt the document, as there were many “behind-the-scenes battles” over it.
“According to Ukrainian law, it is forbidden to divorce during a wife’s pregnancy and in the first year of a child’s life. Until now. Because a bill has just been passed that removes this paternalistic norm. It was the second attempt, there were many behind-the-scenes battles, but the law was passed,” said MP Inna Sovsun.
The document amends Article 110 of the Family Code, which will read as follows: “A lawsuit for divorce may be filed during the wife’s pregnancy and within one year after the birth of the child, except in cases where one of the spouses has committed domestic violence or unlawful behavior that contains signs of a criminal offense against the other spouse, child or other family member.”
From now on, the grounds for divorce during pregnancy and within one year after the birth of a child are not only the commission of a criminal offense, but also domestic violence.
It is worth noting that such violence does not have to be committed against a child or the other spouse. It can be committed against another family member.
The purpose of the act is to improve the mechanism for preventing and combating domestic violence and gender-based violence in connection with the ratification of the Council of Europe Convention on preventing and combating violence against women and domestic violence (Istanbul Convention).
It is worth noting that there were no such restrictions in the laws of many European countries, as they adhere to the voluntary nature of marriage both during its conclusion and dissolution.
