Supreme Anti-Corruption Court obliged NABU to open criminal proceedings against Ukrenergo head Kudrytskyy on corruption articles

The Supreme Anti-Corruption Court of Ukraine has issued a ruling obliging the National Anti-Corruption Bureau to open criminal proceedings against the chairman of the board of Ukrenerho, Volodymyr Kudrytskyy, Komersant ukrainskyi reported, citing data from the register of court rulings.

Thus, in the text of the Resolution of the SACS of 17 July, it is stated that the appealed inactivity of the authorized persons of the NABU regarding the “failure to include in the ERDR information about the possible commission by the chairman of the board of NEC Ukrenergo PERS_8 (Kudrytskyy – ed.) of criminal offences under Art. 209, Art. 364, Art. 368 of the Criminal Code of Ukraine, which, in accordance with the provisions of Art. 33-1 of the Code of Criminal Procedure of Ukraine, taking into account the provisions of para. 2 ч. 5 part 5 of article 216 of the CPC of Ukraine, fall within the jurisdiction of the Supreme Anti-Corruption Court”.

During the trial it was also established that the statement of offence to the NABU was sent on 28.06.2024. In it, “the applicant outlined the circumstances regarding the possible commission of criminal offences by the Chairman of the Board of NEC “Ukrenergo” PERS_8 (Kudrytskyy, – ed.)”.

The SACS satisfied the relevant complaint and ruled: “To oblige the authorised persons of the National Anti-Corruption Bureau of Ukraine to enter into the Unified Register of Pre-Trial Investigations the information on criminal offences on the application of PIO_6 dated 28.06.2024″.

The resolution does not specify in detail what Kudrytskyy’s alleged offences the NABU is now obliged to investigate, but the articles of the Criminal Code of Ukraine listed in the document indicate their corrupt nature:

  • art. 206 of the Criminal Code of Ukraine – legalisation (laundering) of property obtained by criminal means (minimally punishable by imprisonment for a term of three to six years)
  • art. 364 of the Criminal Code of Ukraine – abuse of power or official position (minimally punishable by restriction of liberty for up to three years or imprisonment for the same term)
  • art. 368 UCU – acceptance of an offer, promise or receipt of an undue advantage by an official (minimally punishable by a fine, restriction of freedom or imprisonment for a term of two to four years) .

We will remind, earlier NABU and SAP together with the SBU as a result of joint actions arrested the head of the security Department of NEC “Ukrenergo” on suspicion of overpricing by 10 million hryvnias in the acquisition of body armour in March-April 2022. The latter, according to journalist Serhiy Lyamets, was directly subordinate to the head of the Ukrenerho NEC, Volodymyr Kudrytskyy.
