HACCU vs. the “Queen of the Market”: the high-profile Ivaniushchenko-Molchanova case has entered a new stage

The High Anti-Corruption Court (HACC) has imposed a bail of UAH 100 million on a Kyiv developer suspected of organizing a scheme to seize and legalize 18 hectares of state land with a market value of more than UAH 160 million. This was reported by "Komersant Ukrainian", citing information from the National Anti-Corruption Bureau of Ukraine (NABU).

According to the NABU and the SAPO, the scheme involved a former MP from the Party of Regions (Yuriy Ivanyushchenko, nicknamed “Yura Yenakiyevsky” – ed.), two people under his control, a Kyiv-based developer (Vlada Molchanova – ed.) and her proxy, and the former head of the regional department of the State Geocadastre. All of them were notified of suspicion under Part 5 of Article 191 (misappropriation, embezzlement of property) and Part 3 of Article 209 (legalization of proceeds of crime) of the Criminal Code of Ukraine.

However, Molchanova disagreed with the court’s ruling. The developer claimed that she was a heroine mother and refused to pay bail

What is known about the “Stolychnyi Market case”

The 37-hectare Stolychnyi Market was built in 2010 at the expense of the budget on the land of the state-owned agricultural enterprise Pushcha-Vodytsia. Control over the market was divided: 55% went to Yuriy Ivanyushchenko and 45% to Stolitsa Group.

In 2020, a corporate conflict arose: Stolitsa Group tried to buy out Ivaniushchenko’s stake, but he changed his mind. The conflict was accompanied by clashes, registration attacks, and media publications.

The beneficial owner of Stolitsa Group, Vlada Molchanova, won. According to the registers, the nominal owners of the market are seven individuals and legal entities. However, according to an EP source in the Kyiv City State Administration, Molchanova has been the real owner of the Stolychnyi market in recent years.


How the scheme worked

Officials of the State Geocadastre of Kyiv region, in violation of the established procedure, made changes to the State Land Cadastre, which allowed the agency to dispose of a plot of more than 150 hectares where the market is located. Subsequently, this land was leased to a company controlled by the developer.

Then the head of the company gave up part of the land in favor of 9 pre-determined persons. They received ownership of 9 plots with a total area of 18 hectares, in violation of the land legislation. Later, these plots were sold to three companies related to the developer.

Memorandum and land seizure

After the conflict was resolved, the developer and the former MP signed an informal memorandum on the joint use of the land, including for development. In September 2021, a representative of the former MP became a beneficiary of the companies that own the plots.

Further disposal of the land was stopped after the arrest imposed at the request of SAPO prosecutors.
