HACC reverses acquittal in ZTMC case for the second time: former director sentenced to 3.5 years

The Appeals Chamber of the High Anti-Corruption Court has reviewed the case of embezzlement at Zaporizhzhia Titanium and Magnesium Plant for the second time and this time found the former director of the enterprise guilty.
This was reported by the press service of the Specialized Anti-Corruption Prosecutor’s Office (SAP), "Komersant Ukrainian" reports.
The decision was the next stage in a lengthy trial that began several years ago and has already been subject to cassation review.
What the court decided
According to the Specialized Anti-Corruption Prosecutor’s Office, the appellate instance partially upheld the prosecutor’s complaint in the case of embezzlement of more than UAH 18.6 million.
The previous acquittal of Volodymyr Syvak, former director of ZTMC LLC, was canceled and a new sentence was imposed on him:
- 3 years and 6 months in prison,
- a ban on holding managerial positions for three years,
- a fine of UAH 17 thousand.
The verdict came into force immediately after it was announced, but Syvak has the right to appeal it to the Supreme Court within three months.
Why this case is back in court
This is the second similar decision of the Appeals Chamber. The previous time – in December 2022 – the court also overturned the acquittal. However, following the defense’s cassation appeal, the Supreme Court sent the case back for retrial.
The new verdict shows that the appellate court again concluded that the ex-director’s actions constituted a crime of abuse of office.
The burden on the anti-corruption system
The ZTMC case is one of the most high-profile cases involving state-owned industrial assets. The HACC has repeatedly stated the need to speed up the consideration of proceedings initiated by the NABU and the SAPO, given their complexity and scale.
The current decision of the Appeals Chamber may be final – or it may be returned for cassation, depending on the actions of the defense.
