Military leave: how to get it under the new conditions

Starting from 22 February 2024, the conditions for granting leave to the Ukrainian military have changed. Lawyer Dmytro Franchuk told how long the leave for servicemen now lasts and what is the algorithm for obtaining leave, "Komersant Ukrainian" reports.

According to the expert, the following categories are entitled to leave:

  • military personnel serving in the Armed Forces of Ukraine, the National Guard of Ukraine, the State Border Guard Service of Ukraine
  • military reservists;
  • servicemen who are currently undergoing training.

“Defenders serving in the Armed Forces of Ukraine are entitled to a 30-day leave,” explained Dmytro Franchuk.

He emphasised that these 30 days of leave can now be divided into two parts. The first 15 days will be given to the serviceman at his request, and the next two weeks – by the decision of the military unit commander.

If a soldier is unable to get a leave in the current year, the days of rest will either be transferred to the next year or added to the leave that the defender will take the same year.

Dmytro Franchuk also emphasised that during martial law, a serviceman has the right to paid leave in the same way as in peacetime. No employer can force a defender to go on leave at their own expense. Only those soldiers who are performing combat missions can be restricted in their right to leave.
