New rules will apply to radio frequency users from 2026: what is known

On January 1, 2026, the Law of Ukraine No. 3727-IX dated May 22, 2024, which significantly amended Article 126 of the Law of Ukraine “On Electronic Communications”, came into force in Ukraine. The new rules directly affect users of the radio frequency spectrum, in particular technological users and broadcasters, and provide for increased liability for violations of the law. This was reported by the National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and Postal Services, "Komersant Ukrainian" reports
As it was before
Until January 1, 2026, in case of violation of the law by a radio frequency spectrum user who is not a provider of electronic communication networks and/or services, administrative penalties were applied in accordance with the Code of Ukraine on Administrative Offenses (CAO).
What will change from January 1, 2026
Starting from the new year, for violation of the law:
- technological users of the radio frequency spectrum;
- users of the radio frequency spectrum for broadcasting purposes
- will be subject to administrative and economic sanctions rather than the provisions of the Code of Administrative Offenses.
Important: the amount of administrative and economic sanctions significantly exceeds the fines provided for by the Code of Administrative Offenses.
License is a must
The Law of Ukraine “On Electronic Communications” clearly states that the use of radio frequency spectrum in licensed bands is possible only if a license is obtained.
The use of licensed radio frequency spectrum without a license is punishable by
- seizure of income received as a result of illegal activities, or
- a fine of UAH 170 thousand.
What users should pay attention to
Due to the increased liability, users of the radio frequency spectrum are recommended to:
- check the availability and validity of licenses;
- bring activities in full compliance with the requirements of the law;
- avoid any use of frequencies outside the authorized conditions.
The toughening of sanctions is aimed at increasing market discipline, ensuring the legitimate use of a limited resource and minimizing abuse of the radio frequency spectrum.
