Reservation of persons liable for military service: the government has updated the rules for critical enterprises

The Cabinet of Ministers of Ukraine has updated a resolution defining the procedure for granting the status of critical enterprises. This was reported by the press service of the Ministry of Economy, Environment and Agriculture of Ukraine, "Komersant Ukrainian" reports

It is noted that the adopted changes will contribute to the sustainable functioning of enterprises that develop defense innovations, which play an important role in ensuring the economic stability and defense capability of the state.

What is changing

The list may now include companies that develop defense technologies and innovations without attracting budgetary funds – on the basis of contracts with the Ministry of Defense.

The requirements for the scope of reservation of employees of such companies have also been clarified.

“The adopted amendments introduce a new criterion for determining the criticality of enterprises, institutions and organizations that develop innovations in the defense sector, in particular in the area of creating and improving weapons and military equipment without using budgetary funds. Such enterprises operate on the basis of agreements or contracts concluded with the Ministry of Defense,” said Vitaliy Kindrativ, Deputy Minister of Economy, Environment and Agriculture of Ukraine.


As a reminder, defense companies will be able to temporarily book employees for 45 days, even if they have not yet resolved issues with military registration.

The government has expanded the grounds for reservation from mobilization of 100% of employees of critical enterprises in the frontline regions and allowed drone manufacturers to reserve employees of various types.

How to apply for a reservation through Diia

To book employees, you need to follow a few simple steps:

  • Log in to the Diia portal, select the Employee Booking service, and click Submit an application.
  • Enter the details of the employees you plan to book.
  • Confirm the employee’s salary.
  • Check the accuracy of the entered data and sign the application. The signature is to be put by the head of the company or an authorized person.

The result will be sent to your e-mail and to your account on the Diia portal. If the reservation is successful, it will be displayed in the Employee Pool system.

How to solve the problem with the absence of employees in the registers

If a new employee is not reflected in the registers, contact the Pension Fund of Ukraine (PFU) to update the data. Do this through the Communications with the Pension Fund section of the portal: use the prompt notification* on labor relations – instructions here.

*Submit the prompt notification immediately after hiring, dismissing, or transferring an employee – the same day or the next day.

If you submit the employee’s data on time, the employee will be displayed in the Oberig system and the booking will go smoothly. However, if the information was sent with a delay, submit the Tax calculation through the STS portal for the last reporting period and wait until the Pension Fund updates the information in the register.

Who has the right to book up to 100% of employees?

  • For some businesses, it is possible to book up to 100% of their employees. This applies to:
  • Enterprises of the fuel and energy complex (by decision of the Ministry of Energy).
  • Companies that perform the functions of the technical administrator of the Diia Portal.
  • Enterprises of the defense industry (by decision of the Ministry of Strategic Industries).
  • Enterprises that include full-time national teams of Olympic, non-Olympic sports and sports of persons with disabilities (by decision of the Ministry of Youth and Sports).
  • Specialized UN agencies, foreign diplomatic missions, representative offices of international organizations (by decision of the Ministry of Foreign Affairs).
  • Specialized UN agencies, international judicial bodies, international or non-governmental organizations and institutions of which Ukraine is a member, participant or observer.

There are also categories of employees who can be booked outside the company’s limit, namely

  • Medical workers for whom work in healthcare facilities is the main job.
  • Employees of emergency repair teams that ensure the operation of electronic communication networks.
  • Employees of teams engaged in the construction of blackout-resistant electronic communication networks (using xPON technology) or mobile communication networks.
  • Employees of emergency repair teams that ensure the operation of gas distribution systems.

This way, companies will work for the economy and defense without interruptions for paperwork.
