E-Notary in the crosshairs: how testing the system opened access to citizens’ personal documents

on September 18, personal data of Ukrainians was leaked during the testing of e-notaries. This is reported by "Komersant Ukrainian" with reference to the message of the Notary Chamber of Ukraine (NCU).

It is known that powers of attorney, wills, and supporting documents of citizens were leaked to the public.

All powers of attorney and all wills that were entered into the specified registers before a certain date became available to all testers (notaries who did not perform these notarial acts, employees of territorial bodies involved in testing the system or organizing testing, a wide range of people, including developers, donors, organizers and technical staff), the NPU said.

It adds that this is an unprecedented case of violation of notarial secrecy, which is strictly protected by Article 8 of the Law “On Notaries” and is that the test (training) version of the e-notary contains or provides access to information that constitutes notarial secrecy.

It is known that the test e-notary used real registries, which opened access to citizens’ documents not only to notaries but also to developers.

The Notary Chamber of Ukraine has already appealed to the First Vice Prime Minister and Minister of Digital Transformation Mykhailo Fedorov and Minister of Justice Herman Galushchenko to protect notarial secrecy and stop the testing of the e-notary system.

What preceded it

Earlier, Ihor Fris, MP from the Servant of the People (author of the VRU resolution on limiting government experiments), said that the Cabinet of Ministers was illegally launching projects like e-notaries through Diia, replacing laws with government regulations and creating security risks.

“Diia is good, but when we provide an opportunity to regulate public legal relations through it, which should be regulated by law, this is absolutely unacceptable,” Fries said.

As an example, he cited the launch of a unified electronic notary system through Diia in October 2025. Fries reminded that Ukrainian notaries have been working in electronic systems since 1999, but all further changes must be adopted at the level of the law.

He noted that the draft law provides for the recording of notarial acts in a single electronic register, which is contrary to the law and carries security risks due to the threat of cyberattacks.

The government is already testing a pilot project in Diia, where it will be necessary to register all notarial acts in the electronic register of notarial acts, while creating an appropriate electronic notarial archive. This is not only contrary to the law, but also, given the experience of hacking all registers by Russians, there are no guarantees for such an electronic unified register of notarial acts,” the parliamentarian emphasized.
