The Appeals Chamber of the High Anti-Corruption Court reduced the prison sentence for Yevhen Dykhne, the former CEO of Boryspil Airport, from five to four years in a case involving abuse of office. This was reported by the press service of the High Anti-Corruption Court, according to "Komersant Ukrainian".
As is known, the High Anti-Corruption Court had previously found Yevhen Dykhne and Olesia Levochko, head of the non-aviation contracts department at Boryspil Airport, guilty. Dykhne was sentenced to 5 years in prison, and Levochko to 4 years. The defense filed appeals against the verdict.
“On March 30, 2026, the Administrative Chamber of the High Anti-Corruption Court concluded its review of the defense’s appeals against the High Anti-Corruption Court’s verdict of March 1, 2023, which found the former head of Boryspil International Airport guilty of abuse of office resulting in serious consequences, and the head of the airport’s lease relations department was found guilty of aiding and abetting such actions (Part 5 of Article 27, Part 2 of Article 364 of the Criminal Code of Ukraine). The former head of the international airport received a reduced sentence of up to 4 years of imprisonment, and his accomplice up to 3 years of imprisonment,” the court reported.
Also, pursuant to the court’s decision in favor of the State Property Fund, both defendants were jointly ordered to pay 1.33 million hryvnias in material damages, and procedural costs were awarded to the state.
“The remaining appeals were dismissed. The decision took legal effect upon its announcement and may be appealed to the Cassation Criminal Court within the Supreme Court,” the statement reads.
As a reminder, according to the prosecution, Dykhne, in collusion with Olesya Levochko, head of the non-aviation contracts department at Boryspil Airport, abused his official position to benefit two companies, namely: “Arteria Group” and “Coffee Bar Plus.” The purpose of these abuses was to give them an advantage in obtaining premises for rent on the 3rd floor of Terminal D at Boryspil Airport at an undervalued price, without a competitive bidding process and in circumvention of legal procedures. According to law enforcement estimates, the suspects’ actions resulted in over 16.5 million UAH in losses to the state budget and Boryspil Airport.
The panel of judges noted that the conclusion of the preliminary agreements was unlawful. NABU and the SAPO believed that these unlawful actions caused damages exceeding 16.5 million UAH. The court of first instance assessed the damages at 15.7 million UAH.
At the same time, the defense argues that the actions of the defendant, Dykhne, do not constitute a crime, since a case based on the same facts had already been investigated by another law enforcement agency and was closed on precisely those grounds. Furthermore, according to the defense, Boryspil Airport is not the injured party, as it did not suffer any losses.
