Contract at a standstill: prosecutor’s office identifies risks of overpass construction in Kherson

The Kherson Regional Prosecutor’s Office has filed a lawsuit demanding the termination of a contract for the construction of an overpass in Kherson with a total value of over UAH 1.1 billion, according to "Komersant Ukrainian".

The contract was signed back in 2021, but according to the prosecutor’s office, it has not actually been fulfilled.

At the same time, a significant portion of the funds under the contract has not yet been paid: the balance of budgetary obligations to the contractor amounts to UAH 731 million.

Why the prosecutor’s office went to court

According to the investigation, construction work has not progressed for a long time, and the facility itself has been partially destroyed.

In 2024–2025, the customer repeatedly informed the contractor about the deterioration of the technical condition of the overpass. However, as noted by the prosecutor’s office, no active measures were taken to:

  • record the damage,
  • assessing the technical condition,
  • eliminating the identified defects

What are the risks

Due to the emergency condition of the overpass and the risks to road safety, the regional commission on technogenic and environmental safety and emergencies decided to close this section to traffic.

The prosecutor’s office believes that the continued implementation of the contract under such conditions creates a real risk of inefficient use of budget funds — without completion of construction and without practical results for the city.

What the prosecutor’s office is seeking

The lawsuit was filed in the interests of the state.

Its purpose is to terminate the contract, which is effectively not being fulfilled, to prevent the loss of hundreds of millions of hryvnias in budget funds, and to protect the public interest in conditions of limited resources.
