Metro to Vynohradar: the city tried to sue the contractor twice

The Kyiv Commercial Court has dismissed the claim of the Kyiv Metro utility company to recover UAH 1.6 million from the Kyivmetrobud joint-stock company. The decision was made on July 1, 2025, "Komersant Ukrainian" reports.
“Kyivmetrobud, the company that was commissioned by the Kyiv Metro to build the Vynohradar subway, received the funds but failed to fulfill the agreements. After that, litigation between the parties continued.
This time, the plaintiff demanded to recover UAH 1.6 million from the contractor as part of the unjustly acquired funds. The Metro substantiated its claims by arguing that Kyivmetrobud had used part of the UAH 1.7 billion advance funds for other purposes than their intended purpose, placing them on deposit with Ukrgasbank instead of using them for construction work. As a result, the company received UAH 139 million in interest income, part of which, in the amount of UAH 1.6 million, the plaintiff sought to recover as unjust enrichment.
The court found that according to the decision of the Kyiv Commercial Court of 24 April 2024 in case No. 910/16372/21, which entered into force on 21 October 2024, the entire amount of unjustly acquired funds in the amount of UAH 139 million had already been fully recovered from Kyivmetrobud in favor of the Kyiv City Council at the request of the prosecutor’s office.
The court noted that the subway actually tried to re-collect from the contractor the funds that had already been recovered in another court case. Such double recovery is expressly prohibited by law, which was the basis for the complete dismissal of the claim.

Metro to Vynohradar: one of the most scandalous construction projects in the capital
The Metro to Vynohradar project envisages the extension of the green line of the Kyiv metro from Syrets station to the Vynohradar residential area. Construction began in 2019 with a plan to complete the first phase (Mostytska and Prospekt Pravdy stations) by November 2021.
However, the project faced numerous delays. The general contractor, Kyivmetrobud, asked to postpone the completion date to May 2023 due to lockdowns. Despite this, Mayor Vitali Klitschko promised to open at least one station by the end of 2021.
At the same time, financial irregularities were discovered. According to the State Audit Service’s audit, in 2018-2019, Kyivmetrobud received advance payments of UAH 2.59 billion, but did not use them for their intended purpose. Instead of continuing construction, the contractor placed part of the funds on deposit accounts, including UAH 1.7 billion with Ukrgasbank. In addition, a significant portion of the budget money was used to pay for audit, legal and consulting services, financial risk insurance, and financial assistance to other companies. The funds were practically not allocated for construction. And the contractor received UAH 139 million in interest from the deposit.
Nevertheless, at the end of 2019, Kyiv Metro transferred an additional UAH 1.41 billion to the contractor, of which only UAH 44.1 million was spent.
Due to delays in construction, the Kyiv City State Administration was forced to terminate the contract with Kyivmetrobud. A new contract was signed with Avtostrada. The construction will cost more than twice as much – it will cost UAH 14 billion instead of the originally planned UAH 6 billion.
By the time the new contract was signed, a right turnaround tunnel about 1,250 meters long between Mostytska and Syrets stations had been built.
And after six months of construction by the new contractor had completed only half a percent of the work.
