The problem is solved: parents with children have the right to work remotely

President Volodymyr Zelenskyy has signed a law regulating certain issues of home and remote work. This was reported by the Verkhovna Rada, "Komersant Ukrainian" reports.

The MPs and the head of state resolved a situation in which parents whose children study full-time and remotely, and they themselves are forced to work away from home, had difficulties.

Thus, the signed law stipulates that parents of a child under 14 who is studying remotely will be able to switch to home or remote work in agreement with the employer.

To this end, the Labor Code of Ukraine has been supplemented with a provision on the possibility (upon agreement with the employer) of transferring one of the parents to home-based or remote work in case of distance learning for a child under 14 years of age.

In addition, the law stipulates that home and remote workers may be sent on business trips if it is provided for in their employment contract.

Home and remote work are different things

Ukrainian law provides for two independent forms of labor organization: remote and home-based work.

Remote workers work at any location of their choice. At the same time, they must be in touch with the employer using information and communication technologies.

A home-based worker performs work at the place of residence or in other places designated by him/her outside the employer’s premises. Such work is characterized by a fixed work area or technical means, for example, tools, accessories for the production of products, provision of services or other work. A home-based worker is “tied” to the address specified in the employment contract and can change it only with the employer’s permission.

A home-based worker usually follows the general working hours of the company. Whereas the rules of internal labor regulations do not apply to a remote worker. They distribute their working hours at their own discretion.

It is worth noting that in both forms of work, the duration of working hours is regulated by law:

– normal working hours – up to 40 hours per week;

– reduced hours – up to 24 or 36 hours per week.

Remuneration is paid twice a month, unless the employer and employee agree otherwise. Also, remote workers have all the same rights as other employees: the right to annual vacation, sick leave, and other rights.

By the way, an employee cannot be transferred to remote work without his or her consent, as this is a significant change in working conditions, which the employer must notify two months in advance.
