Prosecutor’s Office returns UAH 451 million distillery to the state: what happened and what are the consequences

The state-owned property complex Kamianske Distillery, which was sold at an electronic auction last year, has returned to state ownership. The reason is that the buyer failed to fulfill the key terms of the sale and purchase agreement. This was reported by the Cherkasy Regional Prosecutor’s Office, "Komersant Ukrainian" reports
What is known about the property
The property complex with an area of more than 26 thousand square meters is estimated at UAH 451 million. The distillery has long been one of the strategic production units of the region and is included in the list of enterprises of important economic importance.
The company was founded in 1820 as a distillery of Vasily Davidov, a Freemason and Decembrist. Since 1819, he lived in Kamianka, Chyhyryn district.

Why the contract was terminated
During the inspection, prosecutors found violations of the contract by the buyer. In particular, he
- did not pay off the debt to the budget,
- failed to fulfill other obligations under the contract after privatization.
Due to the systematic evasion of the terms and conditions, the Cherkasy Regional Prosecutor’s Office filed a lawsuit. The court fully supported the prosecutor’s position and ruled to terminate the sale and purchase agreement for the distillery.
The property has already been returned to the state
The court decision has been enforced: the State Register of Property Rights has been amended and the property complex has been transferred back to the state under the management of the State Property Fund of Ukraine.
This situation demonstrates that the state is strengthening its control over privatization transactions and is ready to return strategic assets in case of failure to fulfill its obligations by the buyers.
