Missile attack and deaths of soldiers in Dnipro region: why SBI suspects negligence

The State Bureau of Investigation has opened a criminal investigation into the deaths and injuries of Ukrainian soldiers in the Dnipro region as a result of a Russian attack. This was reported by the press service of the agency, "Komersant Ukrainian" reports
According to the SBI, an investigative team has arrived at the scene of the tragedy and is taking all the necessary procedural steps. Investigators are establishing the exact circumstances of the incident, including whether the safety requirements for personnel during the air raid were met and whether the shelter for the military was properly organized.
“SBI officers have launched a pre-trial investigation into the deaths and injuries of Ukrainian servicemen as a result of enemy shelling in Dnipropetrovs’k region. In particular, the investigation is checking whether the safety requirements for personnel during the air raid were met and whether the shelter for the military was properly organized,” the statement said.
The investigation is being conducted under Part 4 of Article 425 of the Criminal Code of Ukraine – “Negligent attitude to military service committed under martial law”.
The sanction of the article provides for 5 to 8 years in prison.

What is known about the tragedy in Dnipropetrovs’k region
The incident occurred on November 1, when Russian troops launched a missile attack on the base of Ukrainian defenders. As a result of the attack, servicemen of the Armed Forces of Ukraine were killed and wounded.
on November 3, journalist Dmytro Svyatnenko (TSN) reported that among the dead was his brother, who was killed during an award ceremony in the rear.
The man was 43 years old and served in the 35th Separate Marine Brigade.
“My brother was killed on Saturday. He had been fighting since the 23rd. He went through hell in Krynky, Kurakhovo, Maryanka, Krasnohorivka… He was killed by Russians. But not on the battlefield. In the deep rear. He and his comrades were gathered on the parade ground to be awarded. They gathered the best. The best pilots and infantrymen of the brigade. In an orderly fashion. In an open area. Ballistics came in. The history of negligence (or not) repeated itself,” Sviatnenko said.
At the same time, the 30th Marine Corps assures that they attacked the center of the settlement, where there is no firing ground.
Another attack was reported, during which the brigade’s soldiers were injured. The occupiers hit a gas station, presumably in another region. There were no casualties.
Control and transparency of the investigation
The SBI emphasized that the investigation is being conducted under the supervision of the Prosecutor General’s Office. All details of the incident will be made public after the necessary examinations and interviews with witnesses are completed.
Earlier, the SBI has repeatedly stated that the priority in such cases is to protect the lives of the military and prevent the recurrence of tragic incidents related to negligence or violations during the organization of service.
